Commission Terms of Service

These terms apply to private commissions. Contact catafyra@gmail.com to discuss licensing and commercial commission work.

1. Reservation of Rights

All rights to the artwork are retained by the Artist, including but not limited to electronic rights and usage of all sketches, comps, and preliminary materials. Any grant of rights is conditional upon receipt of full payment. Upon payment in full and completion of the project, the Artist will deliver the digital files necessary for the Client’s granted usage rights. Any use beyond what is expressly granted must be negotiated separately and will incur additional fees. The Artist retains the right to display all work created for the Project, including preliminary materials and final artwork, in their portfolio (both print and online), and may submit such work to design periodicals, competitions, or exhibitions.

2. Process

The Client must provide a clear written description of their concept and supply visual references. The Artist will share work-in-progress screenshots during the commission process. Deadlines must be discussed and confirmed before payment. Rush deadlines may require an additional fee.

3. Revisions

A. Sketch Stage
The Artist offers up to three (3) free revisions during the sketch stage. These are limited to refinements or adjustments to the existing concept. Additional revisions beyond the third, or changes reflecting a new direction or concept, will incur an additional fee.

B. Final Art
Any revisions to completed artwork will require a separate fee, to be negotiated individually.
No additional fee will be charged for adjustments required to meet the originally agreed-upon specifications. The Client agrees to allow the Artist the first opportunity to make any changes to the final artwork.

4. Cancellation and Refunds

The Client may cancel the commission at any time prior to completion. Refunds will be issued based on the stage of progress:

  • Before sketching begins: 100% refund.

  • After sketch completion (excluding sketch commissions): 90% refund.

  • During painting/coloring stage: 25%–75% refund depending on work completed.

  • After final delivery: No refunds will be issued.

If either party cancels before work begins, a full refund will be issued. Upon cancellation, the Artist retains all rights to the artwork, and any digital files shared with the Client must be deleted. No part of the artwork, including preliminary sketches or drafts, may be used or reposted by the Client.

5. Credits and Signature

The Client must credit the Artist when displaying the artwork online. A credit line appropriate to the format or platform must be used. Credit is required regardless of whether the Artist's visible signature is present. The Artist reserves the right to sign the artwork unless otherwise agreed in writing.

6. Payment

All payments are made in USD via invoice. Full payment is due upfront unless a payment plan has been arranged. For commissions exceeding $100, the Client may request a split payment plan:

  • 50% due upfront

  • 50% due upon approval of the colored thumbnail

Rights to the commissioned artwork are granted only after full payment is received and all terms of this Agreement are fulfilled by the Client.

7. Permissions and Releases

The Client agrees to indemnify and hold harmless the Artist against all claims, costs, and legal fees related to the inclusion of any third-party materials, likenesses, or references provided by the Client without proper rights, licenses, or permissions.

8. Miscellany

This Agreement is binding upon both parties and their respective heirs, successors, and assigns. It represents the full agreement between the Artist and the Client and may only be modified in writing, signed by both parties. Email approval of expenses or revisions will be considered valid. Any terms written on a check or payment transfer cannot alter this Agreement unless accompanied by a signed written amendment by both parties.
